William_blackstone  In a previous post we discussed the origins of the foundational ideas that the United States was built upon.  We discussed the common education and understanding of guiding principles shared by the founders.  This understanding and knowledge came from the minds of many great men who had thought and written years before America's birth.  We already talked about Cicero.  Now let's look to some others that inspired the founders.

If Cicero provided a foundation that there is a concept of Natural Law delivered by the hand of a Natural Law Giver, then others expounded upon what rights are inherit under that law.  One among these is the Englishman, John Locke.  Locke wrote:

"The state of Nature has a law of Nature to govern it, which . . . teaches all mankind who will but consult it, that being all equal and independent, no one ought to harm another in his life, health, liberty or possessions; for men being all the workmanship of one omnipotent and infinitely wise maker; all the servants of one sovereign master, sent into the world by His order and about His business; they are His property . . .And, being furnished with like faculties, sharing all in one community of Nature, there cannot be supposed any such subordination among us that may authorize us to destroy one another." (Second Essay Concerning Civil Government, Great Bookos of the Western World, vol. 35)

Notice what Locke is saying here:

1. those of us in Nature have been given a set of Laws which govern our behavior

2. we are all equal and independent under that law

3. we are all created by the same all-powerful Creator

4. we are the servants of the Creator

5. we are here by the order of the Creator

6. we are here to do the Creator's business

7. we are the property of the Creator

8. as such, we are not free to harm each other by the exercise of our own personal freedoms

To get to the details of the rights that are inherit within this structure of Natural Law, we look to William Blackstone, who wrote:

"Those rights, then, which God and nature have established, and are therefore called natural rights, such as are life and liberty, need not the aid of human laws to be more effectually invested in every man than they are; neither do they receive any additional strength when declared by the municipal laws to be inviolable.  On the contrary, no human legislature has power to abridge or destroy them, unless the owner shall himself commit some act that amounts to a forfeiture."

This is what is meant by our founders when they say "unalienable" rights: they are given to us directly by our Creator and are therefore to be respected, protected, and never tread upon by humans or human governmentJohn_locke_2s.  They are "natural" rights.

Then, barely a decade before the Declaration of Independence was written, Blackstone penned the following:

"And these natural rights may be reduced to three principal or primary articles: the right of personal security, the right of personal liberty; and the right of private property; because as there is no other known method of compulsion, or of abridging man's natural free will, but by an infringement or diminution of one or other of these important rights, the preservation of these, inviolate, may justly be said to include the preservation of our civil immunities in their largest and most extensive sense."

So Blackstone summarizes man's natural rights into three main categories:

1. personal security

2. private property

3. personal liberty

Any time a government, individual, or body of any kind infringes upon these three basic, God-given rights, according to Blackstone, a violation of God's laws themselves is occurring.  It certainly makes one wonder about the current state of affairs in our country today, where the government, the court system, and other powers that be are allowed, under the law, to infringe on each of these. 

One can see a clear progression of thought here.  Going from Cicero's declaration that there is a Natural Law provided by a Natural Law Giver, and Locke's testament that we have rights that are inherent under that Law, and Blackstone's delineation of what those specific rights are, we can see the philosophical thread, congruent with a scriptural world view, that took shape to form the basis of America's founding.

    Hello, My Mom sent this to me and I was wondering if anyone knows if any or all of it is true.
    Here it is:
    Our Social Security
    Franklin Roosevelt, a Democrat, introduced the Social Security (FICA) Program. He promised:
    1.) That participation in the Program would be Completely voluntary,
    2.) That the participants would only have to pay 1% of the first $1,400 of their annual Incomes into the Program,
    3.) That the money the participants elected to put Into the Program would be deductible from Their income for tax purposes each year,
    4.) That the money the participants put into the
    Independent “Trust Fund” rather than into the General operating fund, and therefore, would
    Only be used to fund the Social Security Retirement Program, and no other
    Government program, and,
    5.)That the annuity payments to the retirees
    Would never be taxed as income.
    Since many of us have paid into FICA for years and are Now receiving a Social Security check every month
    And then finding that we are getting taxed on 85% of The money we paid to the Federal government to “put Away”you may be interested in the following:
    Q: Which Political Party took Social Security from the Independent “Trust Fund” and put it into the
    General fund so that Congress could spend it?
    A: It was Lyndon Johnson and the democratically
    Controlled House and Senate.
    Q: Which Political Party eliminated the income tax
    Deduction for Social Security (FICA) withholding?
    A: The Democratic Party.
    Q: Which Political Party started taxing Social Security annuities?
    A: The Democratic Party, with Al Gore casting the
    “tie-breaking” deciding vote as President of the
    Senate, while he was Vice President of the US
    Q: Which Political Party decided to start giving
    Annuity payments to immigrants?
    AND MY FAVORITE:
    A: That’s right!Jimmy Carter and the Democratic Party.
    Immigrants moved into this country, and at age 65,
    Began to receive Social Security payments! The
    Democratic Party gave these payments to them,
    Even though they never paid a dime into it!
    Then, after violating the original contract (FICA), the Democrats turn
    around and tell you that the Republicans want to take your Social Security
    away!
    And the worst part about it is uninformed citizens believe it!
    AND CONGRESS GIVES THEMSELVES 100% RETIREMENT FOR ONLY SERVING ONE TERM!!!
    A government big enough to give you everything you want, is strong enough to
    take everything you have.

    Chris,
    These history lessons are invaluable. Thank you and keep ’em coming. You know none of us were taught this in our public schools.
    My pastor shared a great story yesterday that carried these same truths. He talked about a father of a teenage boy. The father would say to his son, EVERY time the son left the house, “Son, remember who you are and whose you are.”
    Remember WHO you are.
    Remember WHOSE you are.
    A great reminder summary of what Locke taught.

    I rented a movie last night called “Stardust”. I would recommend it to everyone. There was no foul language, no blood, some killing. It was a love story of how two people met and fell in love while sharing trials and tribulations and coming to grips with the kind of people they wanted to be. Of course it had a fairy tale ending.

    Those 2 blogs have just given me more understanding of who our forefathers were and why they felt so empowered to do what they did. I remember listening to a couple of tapes, “Understanding your free enterprise business,” by Orrin, and “I think Orrin’s better,” by Chris. As I listened to these tapes in my car, being a part of another organization at the time, I heard ideas and principles that rang true and as I realized we were not being led by individuals who adhered to, or even thought these principles important, I screamed and punched the ceiling of my car. At that moment I knew that me and my family had to make the changes so that our families and friends would someday know these principles to be their currently reality. Thanks for the awsome sources and for the time you took to communicate these truths to us. When we, American’s know the “WHY” behind the “WHAT” we will loyally fight for the cause to create change.

    I appreciate your commentary on the Natural Law. This is good stuff. Natural theology has much to offer… proofs of the existence of God and the soul, universal values and the like. These are good foundational principles on which to launch communication between differing religious perspectives. In a pluralistic society, this is invaluable. Who knows, if we can learn to live together in the USA, maybe we can teach the rest of the world how to do the same.

    So can we start with gas prices going up after each quarter. HMMM? Interesting? I think that violates no.1. That’sjust the start, why doesn’t all government officials (including elected)have to take furlough’s? I’m fine with sacrificing to help the fellow american, but everyone should.

    Amazing contemplation Chris!
    I knew the founding fathers drew off of an intimate knowledge of historical authors like Locke, Montesquieu, Cicero, and the Holy Bible to name a few, but could rarely if ever find the exact article or essay or book. I’m starting to realize that I need to be as hungry, passionate, and committed to my purpose as they were to theirs and you obviously are to yours.
